Terms of Service
The terms for organisations and authorised users who access the PartPack website and production service.
- Effective
- 5 September 2026
- Version
- 1.1
Agreement and eligibility
This endpoint is the PartPack marketing website. Sign-in, account creation, trials and paid service are handled in PartPack Cloud. Website use is governed by the LEVRTEK master service terms, the LEVRTEK privacy policy and the PartPack schedule. Product access is subject to the applicable order or accepted terms.
If you accept these terms for an organisation, you confirm that you have authority to bind it. Individual users must be at least 18 years old and authorised by their organisation. An order, data-processing agreement or negotiated agreement takes priority over these terms to the extent of any inconsistency.
The service
PartPack provides tools to collect, validate, review, approve and deliver engineering packages to suppliers. The features, usage limits, support level, subscription term and any service commitments for a customer are set out in its plan or order.
Customers remain responsible for their engineering decisions, source records, regulatory obligations and the final suitability of every package for manufacture. PartPack assists the handoff process but does not replace qualified engineering review or customer approval controls.
Accounts and administrators
Customers must provide accurate account information, appoint authorised administrators and keep access details secure. Accounts are for named users and must not be shared. Customers are responsible for users they authorise and for promptly removing access that is no longer required.
Tell us promptly at hello@levrtek.com if you suspect compromised credentials, unauthorised workspace access or misuse of a supplier link.
Orders, fees and taxes
Subscription fees, billing frequency, currency and included usage are stated in the order or checkout. Unless the order says otherwise, fees are invoiced in advance, due within 14 days and exclusive of applicable taxes.
We may adjust fees at renewal by giving reasonable advance notice. If an undisputed amount remains overdue after notice, we may suspend paid features until it is resolved. Refunds are provided where required by law or expressly stated in the applicable order.
Acceptable use
You must not use PartPack to break the law, infringe rights, distribute malicious content, probe or bypass security, interfere with the service, misrepresent identity, send unsolicited communications, or access data without permission. You must not reverse engineer the service except where law gives a non-excludable right to do so.
Do not upload classified information or material subject to export controls, defence restrictions or special regulatory handling unless PartPack has agreed in writing that the selected service is suitable for it.
Customer data
Customers retain ownership of engineering files, package data and other content submitted to PartPack. The customer grants PartPack and its subprocessors a limited right to host, copy, process and transmit that data only to provide, secure, maintain and support the service and to follow authorised instructions.
Customers confirm they have the rights and permissions needed to upload customer data and share it with selected users and suppliers. PartPack does not use customer engineering files or personal information to train shared or third-party AI models.
Supplier delivery
The customer controls the recipients, contents, verification settings and expiry of supplier deliveries. Customers must verify recipient details and package scope before sending. Suppliers may use delivered files only for the purpose authorised by the customer and must not redistribute them without permission.
Revocation prevents future access but cannot recall files a recipient already downloaded. The package audit trail records delivery and access events available to the customer.
Security, privacy and confidential information
PartPack maintains the safeguards described in the LEVRTEK security and privacy policy. Each party must protect the other party’s confidential information using reasonable care and use it only for the agreement.
A party may disclose confidential information to personnel, advisers and providers who need it and are bound to protect it, or where law requires disclosure. These obligations do not cover information that is public without breach, already known without restriction, independently developed or lawfully received from another source.
Third-party services and integrations
A customer may choose to connect PartPack to a third-party service. That provider’s terms and privacy practices apply to its service. PartPack is not responsible for a third party’s systems, but remains responsible for its own obligations when using contracted subprocessors to provide PartPack.
PartPack intellectual property
PartPack and its licensors own the service, software, documentation, branding and related intellectual property. During a paid or authorised term, PartPack grants the customer a limited, non-exclusive, non-transferable right for authorised users to use the service for the customer’s internal business purposes.
If you provide feedback, PartPack may use it without restriction or obligation, but will not identify you publicly without permission.
Availability and service changes
Planned maintenance and urgent security work may temporarily affect availability. Any uptime, support, warranty or recovery commitment applies only if expressly stated in the customer’s plan or order.
To the maximum extent permitted by law, the website, service, applications, documentation and outputs are provided “as is” and “as available”. PartPack gives no voluntary warranty—express, implied or statutory—about accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability or error-free operation.
We may improve or replace features while preserving the service’s material function. We will give reasonable notice before a change that materially reduces paid functionality, unless urgent security, legal or third-party circumstances require faster action.
Responsibility and liability
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Subject to those non-excludable rights, neither party is liable for indirect or consequential loss, loss of profit, revenue, opportunity or anticipated savings, except to the extent the loss was reasonably foreseeable and directly caused by that party’s breach. Each party must take reasonable steps to mitigate loss.
Unless an order states another amount, each party’s aggregate liability arising from the service is limited to fees paid or payable for the service during the 12 months before the event giving rise to the claim. The cap does not apply to fraud, wilful misconduct, infringement of the other party’s intellectual property, breach of confidentiality, or liability that cannot legally be limited.
Third-party claims
A customer will defend and indemnify PartPack against a third-party claim caused by customer data infringing that party’s rights or by the customer’s unlawful use of the service. PartPack will defend and indemnify the customer against a third-party claim that the unmodified PartPack service infringes Australian intellectual property rights.
The protected party must promptly notify the other, provide reasonable cooperation and allow the defending party to control the defence and settlement, provided no settlement admits fault or imposes an ongoing obligation on the protected party without consent.
Suspension and termination
Either party may terminate for a material breach that is not fixed within 30 days after written notice, or immediately if the other party becomes insolvent. PartPack may suspend access where reasonably necessary to contain a security threat, prevent unlawful use or protect other customers, and will restore access when the issue is resolved.
A customer may choose not to renew at the end of its subscription term. Termination does not remove payment obligations already incurred.
Data return and deletion
During the subscription and for 30 days after termination, the customer may request a standard export of customer data unless access was terminated for unlawful conduct or law prevents return. After that period, PartPack deletes customer data from active systems and allows encrypted backups to expire in accordance with the Privacy Policy and applicable order.
Changes to these terms
We may update these terms for future orders and renewals. For an active subscription, we will give reasonable notice of a material change and will not apply it retrospectively. Negotiated terms remain unchanged unless both parties agree in writing.
Disputes and governing law
Before starting court proceedings, each party must give written notice of a dispute and allow senior representatives at least 30 days to try to resolve it in good faith. This does not prevent urgent injunctive relief or debt recovery.
Unless an order states otherwise, these terms are governed by the laws of Queensland, Australia, and the parties submit to the courts of Queensland. Mandatory consumer or small-business protections continue to apply.
General
Neither party may assign the agreement without the other’s consent, which must not be unreasonably withheld, except to an affiliate or as part of a merger, restructure or sale of substantially all relevant assets. Neither party is liable for delay caused by events outside its reasonable control, except for payment obligations.
If a term is unenforceable, it is adjusted only as much as necessary and the remaining terms continue. A failure to enforce a term is not a waiver. The agreement, including each applicable order and incorporated document, is the entire agreement about the service.
